Adored Again Marketplace Listing Terms and Conditions

These Terms and Conditions apply when you submit or publish a wedding dress or related item for listing on the Adored Again marketplace at sell.adoredagain.co.nz.
By submitting a listing, paying a listing fee, or otherwise using the Adored Again marketplace, you agree to these Terms.
1. About Adored Again
Adored Again provides an online marketplace where sellers can advertise pre-owned, sample or unworn wedding dresses and where prospective buyers can contact sellers.
Adored Again provides a listing and introduction service only.
Unless expressly stated otherwise, Adored Again:
- does not own, possess, inspect or sell the dresses listed on the marketplace;
- is not the seller's agent, broker, consignee or representative;
- does not guarantee or verify a seller's identity, a dress's authenticity, condition, measurements, ownership or value;
- does not negotiate or agree to a sale on behalf of either party;
- does not arrange or supervise communications, fittings or try-ons;
- does not receive, hold, process or refund the purchase price of a dress;
- does not arrange delivery, collection, insurance or returns; and
- is not a party to any agreement entered into between a buyer and seller.
Any purchase agreement is made directly and solely between the buyer and seller.
2. Seller eligibility
To submit a listing, you must:
- be at least 18 years old;
- have the legal capacity to enter into these Terms;
- own the dress or have the owner's express authority to sell it;
- have the legal right to sell the dress;
- ensure the dress is not stolen, subject to finance, security interests, ownership disputes or third-party claims; and
- provide accurate and current contact information.
Adored Again may request reasonable information to confirm your identity, authority to sell or the accuracy of a listing. This does not mean that Adored Again has verified or guaranteed the seller or dress.
3. Private sellers and sellers in trade
When submitting a listing, you must accurately state whether you are:
- a private seller selling a dress originally acquired for personal use; or
- selling in trade or as part of a business.
If you are in trade, you must clearly identify yourself as a trader and comply with all laws applying to your sale, including the Fair Trading Act 1986 and Consumer Guarantees Act 1993 where applicable.
Adored Again may display the seller's declared status on the listing.
You must promptly notify Adored Again if your seller status changes or if any information you supplied about your status is incorrect.
4. Listing information
You are solely responsible for all information contained in your listing.
You must provide complete, current and accurate information, including where applicable:
- designer or brand;
- style or model;
- label size and approximate street size;
- measurements;
- condition;
- alterations;
- cleaning history;
- damage, stains, marks, wear or missing components;
- whether the dress is a sample, pre-owned or unworn;
- original retail price, where stated;
- asking price;
- location; and
- photographs that fairly represent the dress's current condition.
You must not hide or omit a fault that would reasonably affect a buyer's decision.
You must not include information that is false, misleading, deceptive, defamatory or unlawful.
Measurements, sizing and fit can vary between designers and alterations. Sellers must use reasonable care when providing measurements, and buyers should independently confirm measurements and fit before purchasing.
5. Authenticity and prohibited listings
You must not list:
- counterfeit or replica dresses presented as genuine;
- stolen goods;
- dresses you do not own or have authority to sell;
- items that infringe intellectual property rights;
- misleading, fraudulent or unlawful listings;
- unsafe or recalled products; or
- content unrelated to the Adored Again marketplace.
If you describe a dress as authentic or identify a designer or brand, you must have reasonable grounds for doing so.
Adored Again may request supporting information, remove a listing, decline publication or suspend access where it reasonably believes a listing may breach these Terms or applicable law.
6. Photographs and content licence
You confirm that:
- you own the photographs and content you upload, or have permission to use them;
- the content does not infringe another person's copyright, privacy or other rights; and
- you have permission from any identifiable person shown in a photograph.
You grant Adored Again a non-exclusive, worldwide, royalty-free licence to host, reproduce, crop, resize, edit for presentation, publish and promote your listing content for the purpose of operating and marketing the Adored Again marketplace and your listing.
This licence ends within a reasonable period after your listing is permanently removed, except for material already included in archived, scheduled or previously published marketing content.
7. Listing review
Adored Again may review listings for completeness, presentation and apparent compliance with these Terms.
A review does not constitute:
- authentication;
- a physical inspection;
- confirmation of ownership;
- confirmation of a seller's identity;
- an appraisal or valuation;
- approval of the condition or quality of the dress; or
- a recommendation or endorsement by Adored Again.
Adored Again may edit spelling, formatting, image order or layout without materially changing the information supplied by the seller.
8. Listing fee
The applicable listing fee is the amount displayed on the website before payment and is charged for the listing service, not for achieving a sale. Adored Again may offer promotional pricing or change the fee from time to time, including in response to demand.
Unless otherwise stated at checkout:
- the listing fee is a one-off fee;
- no sales commission is payable to Adored Again;
- Adored Again does not guarantee enquiries, appointments or a sale;
- the fee does not include photography, authentication, cleaning, storage, delivery, payment processing for the dress, fitting services or dispute resolution; and
- the fee is non-refundable once the listing has been reviewed and published, except where required by law.
If Adored Again declines a listing before publication, Adored Again will refund the listing fee unless the listing was rejected because it was fraudulent, unlawful, counterfeit or materially breached these Terms.
Adored Again may change its fees for future listings. The amount clearly displayed and accepted at checkout applies to that submission. A later fee change will not retrospectively change the fee already paid for a listing.
9. Listing period and availability
A listing will remain live for six months, unless:
- the seller marks the dress as sold;
- the seller requests removal;
- the listing expires;
- Adored Again removes it under these Terms; or
- the marketplace service is discontinued.
The seller must promptly update or remove a listing if the dress is sold, withdrawn or no longer available.
Adored Again does not guarantee uninterrupted or permanent availability of any listing or marketplace service.
10. Buyer enquiries and direct communication
Adored Again may provide an enquiry form that allows a prospective buyer's message and contact details to be forwarded to the seller.
The enquiry form is an introduction facility only. Adored Again does not negotiate, monitor, manage or participate in subsequent communications.
Once contact has been made, the buyer and seller are solely responsible for:
- deciding whether and how to continue communicating;
- verifying each other's identity;
- arranging any viewing or try-on;
- agreeing on price and sale terms;
- choosing a payment method;
- arranging delivery or collection;
- documenting the agreement; and
- resolving any issue or dispute.
Adored Again may block suspected spam, abusive enquiries or apparent scams but does not guarantee that all harmful or fraudulent communications will be detected.
11. Try-ons, meetings and personal safety
All fittings, try-ons, collections and in-person meetings are arranged directly between the buyer and seller and are undertaken at their own risk.
Adored Again does not provide, approve, supervise or inspect meeting locations.
Users should take reasonable safety precautions, including:
- meeting in a safe and appropriate location;
- telling another person where they are going;
- avoiding unnecessary disclosure of personal information;
- confirming the other person's identity;
- having another adult present where appropriate; and
- not handing over a dress until cleared payment has been received.
Adored Again is not responsible for the conduct of buyers, sellers or other persons during private communications or meetings.
12. Payment and completion of sale
The purchase price for a dress must be paid directly by the buyer to the seller using a payment method agreed between them.
Adored Again:
- does not collect or hold the purchase price;
- does not provide an escrow service;
- does not confirm that payment has cleared;
- does not issue purchase-price refunds;
- does not guarantee payment or delivery; and
- is not responsible for chargebacks, bank transfers, cash payments, scams or payment disputes.
Buyers and sellers are responsible for carrying out their own checks before sending money, releasing a dress or sharing sensitive information.
13. Delivery, collection, returns and refunds
The buyer and seller must agree directly on delivery, collection, insurance, risk of loss, returns and refunds.
Adored Again does not set or administer a marketplace-wide return policy for dresses sold directly between users.
Any return, refund, repair or other remedy must be addressed between the buyer and seller according to their agreement and any applicable law.
14. Disputes between buyers and sellers
Adored Again is not responsible for resolving disputes between buyers and sellers and is not required to determine who is at fault.
Users must first attempt to resolve transaction disputes directly with each other.
Adored Again may, at its discretion:
- receive reports about misuse of the marketplace;
- request information relating to a complaint;
- remove or suspend a listing or user; or
- refer suspected fraud or unlawful conduct to an appropriate authority.
Taking any of these actions does not make Adored Again a party to the transaction or create an obligation to investigate or mediate a dispute.
15. Marketplace availability and third-party conduct
Adored Again does not guarantee:
- that a listing will result in enquiries or a sale;
- the accuracy of information supplied by users;
- the identity, reliability or conduct of any user;
- the quality, authenticity, condition, fit or value of a dress;
- that a dress remains available;
- that a buyer will pay;
- that a seller will deliver; or
- that the website will always be uninterrupted or error-free.
Users must make their own enquiries and exercise their own judgement before entering into a transaction.
16. Removal and suspension
Adored Again may decline, edit, suspend or remove a listing where reasonably necessary to:
- enforce these Terms;
- comply with law;
- respond to an intellectual property or privacy complaint;
- protect users or the marketplace;
- address suspected fraud, scams or misleading content;
- correct a technical or pricing error; or
- prevent misuse of the service.
Where reasonably practicable, Adored Again will explain the reason for removal.
No refund is required where a listing is removed because the seller materially breached these Terms, except where required by law.
17. Liability
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including any applicable rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or Privacy Act 2020.
To the maximum extent permitted by law, Adored Again is not liable for loss arising from:
- information, photographs or representations supplied by a seller;
- the condition, authenticity, ownership, fit or value of a dress;
- the acts or omissions of a buyer, seller or other third party;
- communications, meetings or try-ons arranged between users;
- payment, delivery, collection, return or refund disputes;
- scams, fraud or unauthorised payment activity outside Adored Again's reasonable control; or
- indirect or consequential loss, including loss of profit, opportunity or anticipated savings.
Where Adored Again is legally liable in connection with its paid listing service and liability can lawfully be limited, Adored Again's total liability will not exceed the listing fee paid for the affected listing.
This section does not limit liability for fraud, wilful misconduct or any liability that cannot lawfully be limited.
18. Seller indemnity
To the extent permitted by law, you agree to reimburse Adored Again for reasonable losses, costs or claims resulting directly from:
- your material breach of these Terms;
- your unlawful, fraudulent or misleading listing;
- your infringement of another person's intellectual property or privacy rights; or
- your lack of ownership or authority to sell the dress.
This clause does not apply to the extent that the loss was caused by Adored Again's own breach, negligence or unlawful conduct.
19. Privacy
Adored Again collects, uses, stores and shares personal information in accordance with its Privacy Policy and the Privacy Act 2020.
Information submitted through a buyer enquiry form may be disclosed to the relevant seller for the purpose of enabling direct communication about that listing.
Users must only use contact information received through the marketplace for the relevant enquiry or transaction. It must not be used for unrelated marketing, sold, published or disclosed to others without permission or another lawful basis.
20. Changes to these Terms
Adored Again may update these Terms from time to time.
The Terms displayed and accepted when a listing is submitted will apply to that listing, unless a change is required by law or the seller expressly agrees to updated Terms.
Material changes affecting an existing listing will be communicated where reasonably practicable.
21. Governing law
These Terms are governed by New Zealand law.
The New Zealand courts will have non-exclusive jurisdiction over disputes relating to these Terms, subject to any rights a user may have under applicable consumer law.
